By Michael Shaw – Barrister Mrs. A was diagnosed with Giant Cell Arteritis (GCA). It is a serious autoimmune condition that requires urgent treatment. This is necessary to prevent severe complications, including irreversible sight loss. Initially, her condition was managed appropriately, and her symptoms were brought under control with high-dose steroids. However, as her treatment progressed, her steroid dosage was tapered, and her condition began to deteriorate. By mid-2020, her inflammatory markers were rising exponentially. She was experiencing significant physical and cognitive decline. She also had symptoms of polymyalgia and fatigue. Despite these clear signs of a relapse, her healthcare providers failed to act decisively. The steroid dosage was not increased to therapeutic levels as recommended by national guidelines. Additionally, her symptoms were misinterpreted as being caused by other conditions. This mismanagement led to a delay in treatment, and tragically, Mrs. A lost vision in her right eye in November 2020. Shortly thereafter, her left eye also suffered significant visual impairment. This left her unable to drive. She could not navigate her surroundings independently. She was unable to enjoy many of the activities she once loved. The legal case was complex, requiring a detailed examination of medical records, expert opinions, and the application of clinical guidelines. I collaborated with top specialists in rheumatology. I also worked with experts in ophthalmology to identify breaches of duty. Together, we established the causal link between the inadequate treatment and Mrs. A’s injuries. The evidence showed that her healthcare providers failed to recognize the severity of her condition. They did not take the necessary steps to prevent the devastating outcome. Throughout the case, my focus was on ensuring that Mrs. A’s voice was heard and that her suffering was acknowledged. Her story was one of resilience in the face of adversity. It was my duty to advocate for her with the utmost professionalism and determination. I negotiated a settlement figure with the solicitor acting for the Defendant NHS Trust. The client was happy to accept this figure, and so the case settled. We thank you, again, for achieving the £XXXk settlement by going in high.
