Court: King’s Bench Division – NEGLIGENCE ~ CLINICAL NEGLIGENCE ~ BREACH OF DUTY.

•This is a clinical negligence claim in the King’s Bench Division, concerning the alleged negligent performance of surgery to insert a percutaneous endoscopic gastrostomy (PEG) feeding tube into the claimant.
•The court found that the defendant breached the duty of care by leaving the claimant with a PEG that was fitted with too much tension.
•The court determined that the breach of duty caused necrosis; a loss of mobility; an acceleration of the claimant’s progression to complete incontinence by 6 years; an acceleration to complete PEG feeding; and the need for a tracheostomy.
